Supreme Court's Big Decision Regarding Riders With LMV Driving License

Supreme Court's Big Decision Regarding Riders With LMV Driving License

New Delhi: Drivers with Light Motor Vehicle (LMV) license will now be allowed to drive heavy vehicles. However, they can drive vehicles weighing up to 7,500 kg. The Supreme Court of India gave an important verdict on Wednesday. A 4-member constitutional bench chaired by Chief Justice D. Y. Chandrachud has given the above verdict. As a result, there will be clarity in licensing regulations and insurance companies will stop denying compensation based on the driver's license in case of an accident. 

On Wednesday according to the verdict given by the Supreme Court, drivers who have a light motor vehicle license can drive a 7,500 kg maximum transport vehicle. 

The Supreme Court in its judgment said that there is no empirical evidence that light vehicle license holders are responsible for the increasing number of accidents in the country. Justice Hrishikesh Roy, who was part of a four-judge constitution bench headed by Chief Justice D.Y. Chandrachud, said that the case is related to the livelihood of light vehicle license holders. 

While the verdict has brought relief to commercial vehicle drivers, it has come as a blow to insurance companies that have been denying compensation to drivers of heavy vehicles of a certain weight in the event of an accident based on the type of license required. 

This issue has been controversial for a long time. The insurance company alleged that the Insurance Accident Claims Tribunal and the courts were ignoring their complaints regarding the light vehicle license and directing them to pay the insurance claims. 

Also, during the hearing, the court was taking a view in favor of the insured. The constitution bench consisted of the Chief Justice, Justice Roy, Justice PS Narasimha, Justice Pankaj Mithal and Justice Manoj Mishra.
