Article 370 abrogation in Jammu and Kashmir upheld by Supreme Court

New Delhi, Dec 11: In a historic ruling on Monday, the Supreme Court affirmed the abrogation of Article 370, marking a significant decision on petitions challenging the special status revocation for Jammu and Kashmir under the Indian Constitution. The judgment upheld the validity of the Union government's 2019 decision to end the region's special status.
During the proceedings, the court clarified that Jammu and Kashmir lacked internal sovereignty, emphasizing that the state government's consent was unnecessary for the application of the Indian Constitution. Notably, the court highlighted the temporary nature of Article 370 and mandated the restoration of Jammu and Kashmir's statehood. Additionally, it instructed the Election Commission of India to initiate preparations for the legislative assembly elections in Jammu and Kashmir by September 30, 2024.
The five-judge Constitution bench, led by Chief Justice of India DY Chandrachud and including Justices SK Kaul, Sanjeev Khanna, BR Gavai, and Surya Kant, delivered the verdict. There were three judgments in the case: one authored by CJI Chandrachud for himself and Justices Gavai and Surya Kant; the second was a concurring opinion by Justice SK Kaul, and Justice Sanjiv Khanna concurred with both judgments.
