Odisha directs doctors to expedite exams for rape survivors under new law

Bhubaneswar, July 2: In an effort to bolster support for survivors of sexual assault, the Health and Family Welfare (H&FW) department has directed all government, private doctors, and registered medical practitioners to conduct medical examinations of rape or attempted rape victims under the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
Shalini Pandit, Commissioner-cum-Secretary of the H&FW department, issued a notification outlining the mandate. According to the notification, "Under Section 184 of the BNSS, 2023, every victim woman alleging rape or attempted rape shall undergo examination by a doctor or medical practitioner from hospitals, whether public or private, under the jurisdiction of the Central government, state government, local bodies, or other entities, with consent from the woman or her authorized representative."
Additionally, the Health Department specified that medical examination reports for rape victims must be issued within seven days in accordance with the new legal provisions.
This directive underscores the importance of prompt medical attention for survivors of sexual assault, ensuring examinations are conducted without delay. The notification emphasizes that any delay in conducting the examination must be documented, including reasons for the delay, in both the register and the examination report. It also mandates recording the exact start and end times of the examination.
This move aims to streamline and expedite medical care for survivors of sexual violence, ensuring they receive necessary support promptly and efficiently.
