Orissa High Court orders seizure of Chinese ship at Paradip Port

Bhubaneswar, July 31: The Orissa High Court has recently ordered the seizure of a Chinese ship, MV ZHE HAI 505 (IMO number-9567477), anchored at Paradip Port.
Sources report that the ship was likely to leave Paradip Port without the seizure order, prompting the Court to clarify the necessity of immediate action.
The single bench of the High Court, comprising Justice V. Narasingh, issued the decree in favor of Scandi Trading Limited. The order mandates the Chinese ship to settle a claim of Rs 99.81 lakh for the low supply of goods under Section 4(1)(l) of the Admiralty (Jurisdiction and Settlement of Maritime Claims) Act, 2017.
The dispute arose between the petitioner trading company and the ship’s owner over the low supply of sulfur marine gas oil. The ship’s owner was supposed to pay the petitioner ₹99,81,553. Due to the owner's failure to pay, the trading company approached the High Court.
The case was filed under Section 4(1)(A) of the Admiralty (Jurisdiction and Settlement of Maritime Claims) Act, 2017. The court’s direction came after hearing the petitioner’s arguments and reviewing the submitted documents, finding prima facie evidence and deeming the case worthy of trial.
